The subscription terms are hereby set out and legally binding.

Contractual Agreement between Untitled Gallery Limited & Artist / Subscribing part for annual subscription on untitledgallery.co.uk. 

As our policy offers free delivery on artworks across all United Kingdom destinations the Artist must incorporate and absorb an accurately calculated costs for shipping and packing into the sale price of each artwork. The Artist remains responsible for all elements regarding the costs and organisation on shipping their artworks safely, efficiently and directly to the client. All artworks must be created by the Artist with no third party, dealer, agent or gallery involvement as all exhibitors are required to sell their work at commission free prices. The Artist must own the legal copyright of all artworks exhibited and provide the relevant proof, paperwork or certificate to clients where necessary or on request. For quality control each Artist must have first submitted works and received written or verbal confirmation of acceptance. All works will be reviewed individually on the grounds of quality and content and are to be sold directly by Artists with no agents or galleries involvement and with no commission incorporated into the selling price. Untitled Gallery Limited retain the right to refuse to upload artworks considered either unsuitable or offensive unless an acceptable and clear context is evident regarding the artistic statement and intent. Unless previously agreed, all information and images are to be sent at the same time in order to be added to the website in one sitting and must adhere to the quality, standards and specifications of existing pieces on the website. Images provided by the Artist must also all meet specifications listed below (see page 2) and will be copied into the relevant categories at the discretion of Untitled Gallery Limited. The full artwork sale amount will be received on the Artists behalf by Untitled Gallery Limited whereupon the Artist will be made aware of the transaction. It is the Artists responsibility to inform Untitled Gallery Limited immediately if any of the exhibited artworks become unavailable. Only pieces sold via the Untitled Gallery website will be updated unless previously stated in writing. To cover banking and transaction fees a 3% gross administrative levy will be deducted from each sale. Artists are liable for all banking fees and costs incurred on transfer of the balance from Untitled Gallery Limited. Untitled Gallery Limited accepting no responsibility for disputes, returns or refunds being either made or requested by the Artist or customer. At the point of a sale the Artist takes sole responsibility for the sale, including potential refunds, returns and postage, packing and shipping expenses. In circumstances where an artwork is sold and is not available to the client the Artist accepts full responsibility for this oversight and will be liable for 3% gross of the transaction. Untitled Gallery Limited aim to transfer all sales income directly to the Artist within 10 working days of receipt of payments from clients and/or on receiving a correct, professional invoice from the Artist. Untitled Gallery Limited are alleviated from all responsibility and involvement in sales from other than receiving payments on behalf of the Artist. Artwork images and information will only be uploaded to the website on receipt of all relevant data being provided to the correct specifications provided by Untitled Gallery Limited. All Artists are solely responsible for their personal and corporate VAT and Tax payments in line with their country of residence. This agreement must be printed, signed and returned by post before promotion or sales of your work can commence. All subscription cancellations must be sent via email more than 4 weeks prior to the renewal date as all payments received are non-refundable. Receipt of the Artists payment will be a binding and non-refundable renewal confirmation. No renewal notification will be sent. If the Artist has not provided all images and information to specification within 12 weeks of the initial subscription payment then Untitled Gallery Limited will be released from all obligations and all nonrefundable payments will be retained by Untitled Gallery Limited and therefore forfeited by the Artist. These Terms & Conditions are subject to changes and amendments. Untitled Gallery Limited are not liable for any loss or damages incurred to the Artist, loss or damage to artworks, computer virus, corruption or of data or content and are excused from the performance of all obligations if performance is hindered or prevented directly or indirectly by strike, lock-out, lockdown, labor, disturbance, biological virus infection, lockdown, epidemic, pandemic, government action, riot, armed conflict, accident, unavailability or breakdown of normal means of transport, Act of God, ruling by a venue, landlord and/or its committee or staff.
